- Parties: Collectively refers to Hollahop B.V. and the Customer.
- Consumer: A Customer who is an individual acting for purposes outside their business, trade, craft, or profession.
2. Applicability
- These Terms apply to all offers, services, orders, agreements, and deliveries by Hollahop B.V. via this website.
- Deviation from these Terms is only valid when expressly agreed in writing.
- The applicability of any customer or third-party terms is expressly excluded.
3. Offers and Quotations
- Offers and quotations on this website are non-binding unless explicitly stated otherwise.
- Validity of any offer or quotation is 1 month unless a different period is specified.
- Offers and quotations do not automatically apply to repeat orders unless explicitly agreed in writing.
4. Acceptance
- Acceptance of a non-binding offer or quotation allows Hollahop B.V. to withdraw within 3 days after receiving acceptance.
- Verbal acceptances are binding only after written (including electronic) confirmation by Hollahop B.V.
5. Prices
- Prices are in Euros, inclusive of VAT, and exclusive of any other costs, unless stated or agreed otherwise.
- Hollahop B.V. reserves the right to adjust prices at any time.
- The agreed total price is considered a target price unless a fixed price agreement is explicitly made.
6. Payment Terms
- Hollahop B.V. may request a down payment of up to 50% at the agreement’s conclusion.
- Full payment is due within 1 month post-delivery of the service.
7. Late Payment Consequences
- Interest charges for late payments and extrajudicial collection costs will be applied as stipulated.
- Hollahop B.V. may suspend obligations until full payment is received.
8. Right of Withdrawal
Consumers have a 14-day right of withdrawal from online purchases, with specified exceptions.
9. Performance of the Agreement
- Hollahop B.V. commits to executing the agreement to the best of its ability and in accordance with good workmanship.
- Execution details, including the start time and any necessary customer provisions, are mutually agreed upon.
10. Intellectual Property
Intellectual property rights of all materials, designs, and content provided by Hollahop B.V. remain with the company unless otherwise agreed.
11. Liability and Indemnification
- Liability of Hollahop B.V. is limited to direct damages caused by intent or gross negligence.
- Customers indemnify Hollahop B.V. against third-party claims related to the services or products provided.
12. Complaints Procedure
Complaints must be reported within a specified period after discovering any service deficiencies.
13. Applicable Law and Jurisdiction
These Terms are governed by Dutch law, and any disputes will be subject to the jurisdiction of the Dutch courts in the district where Hollahop B.V. is established.
Changes to Terms and Conditions
Hollahop B.V. reserves the right to modify or amend these Terms at any time. Significant changes will be communicated to the Customer.
